    § LEGAL / TERMS OF SERVICE

    Terms of Service

    1. Agreement to Terms

    By accessing and using bouncecheck.email ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

    2. Definitions

    • "Service" means the email verification services provided at bouncecheck.email, including the API, dashboard, and related tools.
    • "Customer", "you", or "your" means the individual or entity accessing the Service.
    • "Customer Data" (or "Validation Data") means any email addresses, lists, files, or other data you submit to the Service for verification or processing.
    • "Confidential Information" means non-public information disclosed by either party, including Customer Data and BounceCheck's proprietary technology, that is marked confidential or would reasonably be understood to be confidential.
    • "API Key" means the credential issued to you to authenticate requests to the Service.

    3. Description of Service

    bouncecheck.email provides email verification services including:

    • Email syntax validation
    • DNS and MX record verification
    • SMTP connection testing
    • Disposable email detection
    • API access for bulk verification

    4. License Grant & Restrictions

    Subject to your compliance with these Terms and payment of applicable fees, BounceCheck grants you a revocable, non-exclusive, non-transferable, worldwide right to access and use the Service for your own internal business purposes.

    You agree not to: (i) license, sublicense, sell, resell, rent, or otherwise make the Service available to any third party except as expressly permitted; (ii) modify or create derivative works based on the Service; (iii) decompile, disassemble, reverse-engineer, or attempt to discover the source code or underlying structure of the Service; or (iv) use the Service to build, train, or support a competing product or service.

    5. User Accounts

    When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

    You are responsible for safeguarding your account password and for any activities or actions under your account.

    6. Acceptable Use

    You agree not to use the Service:

    • For any unlawful purpose or to solicit others to perform or participate in any unlawful acts
    • To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances
    • To send spam or unsolicited communications
    • To harvest or collect email addresses or other contact information of others
    • To interfere with or circumvent the security features of the Service
    • To abuse, harass, threaten, impersonate or intimidate any person

    7. Customer Responsibilities

    You are responsible for all activity occurring under your account and for your use of the Service and any results obtained from it.

    You represent and warrant that you have the right and legal authority to submit any Customer Data to the Service, and that your collection, submission, and subsequent use of such data complies with all applicable laws and regulations, including but not limited to the GDPR, CCPA, and applicable anti-spam laws such as CAN-SPAM. You are solely responsible for ensuring you have a lawful basis to process the email addresses you submit for verification.

    8. API Usage and Limits

    API usage is subject to rate limits based on your subscription plan. Exceeding these limits may result in temporary suspension of service or additional charges.

    You must not attempt to bypass or circumvent API rate limits through any means.

    9. Customer Data, Privacy & Retention

    Ownership. You retain sole ownership of all Customer Data. Nothing in these Terms transfers ownership of your Customer Data to BounceCheck.

    Use. BounceCheck accesses and uses Customer Data solely to provide and support the Service. We do not sell your Customer Data.

    Security. Customer Data submitted to the Service is stored in encrypted form.

    Retention & Deletion. We retain your Customer Data, including your verification jobs and results, for as long as your account exists, so that it remains available to you. Your data is not deleted when a subscription ends or when you downgrade to a free plan. You may delete your Customer Data at any time through your dashboard. Data is permanently deleted only when you explicitly delete it or delete your account.

    Privacy Policy. Our handling of personal data is further described in our Privacy Policy, which is incorporated into these Terms by reference. In the event of a conflict, these Terms control to the extent of the conflict.

    10. Confidentiality

    Each party may have access to the other's Confidential Information. The receiving party agrees to use at least reasonable care to protect the disclosing party's Confidential Information and not to disclose it to any third party except as necessary to perform under these Terms.

    Confidential Information does not include information that: (a) is or becomes publicly available through no fault of the receiving party; (b) was already known to the receiving party without a duty of confidentiality; (c) is received from a third party without breach of any obligation; or (d) is independently developed. A party may disclose Confidential Information if required by law or court order, provided it gives prompt notice where legally permitted.

    BounceCheck acknowledges that your Customer Data is your Confidential Information.

    11. Use of Identifying Information

    You consent to being identified as a customer of BounceCheck on our website and in our promotional materials, including our use of your company name and logo for this limited purpose. You may withdraw this consent at any time by sending a written request to [email protected], and we will cease such use within a reasonable period.

    12. Payment and Billing

    Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis. Billing cycles are set on a monthly or annual basis.

    All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

    13. Subscription Cancellation Policy

    The Service is made available on a month-to-month or annual subscription basis, as selected at purchase. You may cancel your subscription at any time through the billing section of your account dashboard, or by contacting us at [email protected]. Cancellation takes effect at the end of your current billing period, and you will retain access to the Service until that date. No refunds are provided for any charges incurred or processed prior to cancellation, except as expressly stated in the Refunds & Credits section.

    14. Refunds & Credits

    We offer refunds within 14 days of purchase for subscription plans, provided that you have not exceeded your plan's usage limits.

    Add-on Credit packs are one-time purchases that do not auto-renew. Purchased credits do not expire and remain available on your account until used. API credits are non-refundable once purchased.

    Credit-based remedy. Where a verification cannot be completed, returns only a provisional result as described in the Verification Accuracy section, or is otherwise affected by a service issue on our side, our sole remedy is to re-credit the affected verifications to your account. Such re-credits are issued as usage credits, not as monetary refunds. Except for the subscription refund window described above, all fees paid are non-refundable, and credit re-issuance is provided in lieu of any cash refund.

    15. Intellectual Property

    The Service and its original content, features, and functionality are and will remain the exclusive property of bouncecheck.email and its licensors. The Service is protected by copyright, trademark, and other laws.

    16. Representations & Warranties

    Each party represents and warrants that it has the legal power and authority to enter into these Terms.

    You represent and warrant that: (a) you have the right and authority to submit the Customer Data to the Service; and (b) you will comply with all applicable laws and regulations in connection with your use of the Service.

    BounceCheck represents and warrants that it will provide the Service in a manner consistent with general industry standards and will use commercially reasonable encryption to protect Customer Data in its possession. Except as expressly stated in these Terms, the Service is provided "AS IS" as described in the Disclaimer section.

    17. Indemnification

    By you. You will indemnify, defend, and hold harmless BounceCheck and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Customer Data; (b) your use of the Service in violation of these Terms or applicable law; or (c) a third-party claim that your submission or use of Customer Data was unlawful or unauthorized.

    By BounceCheck. BounceCheck will indemnify, defend, and hold you harmless from and against any third-party claim alleging that the Service, as provided and used in accordance with these Terms, directly infringes that third party's intellectual property rights.

    Process. The indemnified party must: (i) promptly notify the other party in writing of the claim; (ii) give the indemnifying party sole control of the defense and settlement; and (iii) provide reasonable cooperation.

    18. Verification Accuracy and Provider Limitations

    Email verification is inherently probabilistic and is provided on a best-effort basis. A result — including a "Valid" status — is an assessment of an address at the time of the check, not a guarantee that a message sent to it will be delivered, opened, or accepted. Results may differ between repeated checks of the same address.

    Some mailbox providers deliberately restrict, delay, or generalize the responses their mail servers give to verification requests, which limits how accurately any provider — including us — can verify their addresses:

    • Yahoo and Yahoo-operated domains (including AOL and various regional Yahoo domains such as yahoo.co.uk and yahoo.fr) frequently accept every address regardless of whether the mailbox exists. For these, the Service may return a provisional result labelled "default pass", "accept-all", "risky", or "unknown" rather than a definitive verdict. A "default pass" result means the address passed our other checks but could not be confirmed at the mailbox level, and does not confirm deliverability.
    • Microsoft/Outlook and many corporate or education mail systems apply similar restrictions or rate limits, which can produce "unknown" or provisional results, or transient failures on individual checks.

    You are responsible for exercising your own judgement before relying on any result for sending, list hygiene, compliance, or other decisions. To the fullest extent permitted by law, we do not warrant the accuracy, completeness, or timeliness of verification results and accept no liability for actions taken in reliance on them.

    No credit charged for Yahoo-type provisional results. Because addresses on Yahoo and Yahoo-operated domains (including AOL and regional Yahoo domains) cannot be reliably confirmed at the mailbox level, verifications that return a provisional result for these domains — such as "default pass", "accept-all", "unknown", or "risky" — are not charged against your credit balance. You are only charged credits for verifications that return a definitive result.

    19. Disclaimer

    Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.

    20. Limitation of Liability

    In no event shall bouncecheck.email, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

    To the maximum extent permitted by law, BounceCheck's total aggregate liability arising out of or related to these Terms, under any theory of liability, will not exceed the total amount of fees you paid to BounceCheck for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.

    21. Termination

    We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

    22. Force Majeure

    Neither party will be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, epidemics or pandemics, acts of government, labor disputes, or failures of third-party infrastructure, internet, or hosting providers.

    23. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.

    24. Dispute Resolution

    Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, United States, and the parties consent to the personal jurisdiction of such courts.

    25. General Provisions

    Assignment. You may not assign these Terms without BounceCheck's prior written consent. BounceCheck may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.

    Notice. BounceCheck may provide notice to you via the email address associated with your account. Legal notices to BounceCheck must be sent to [email protected].

    Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

    Waiver. BounceCheck's failure to enforce any right or provision will not constitute a waiver of that right or provision.

    Relationship. No joint venture, partnership, employment, or agency relationship is created by these Terms.

    Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and BounceCheck and supersede all prior agreements regarding the Service.

    26. Changes to Terms

    We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
